validity of undated affidavit in dv case

Affidavit must be attested by oath commissioner with the date mentioned.

There must be a stamp of oath comissioner with date.

If it is not there ask the judge to order for properly attested.

I verified the affidavit again and there is no date.

The case is running from 1 year with out a date and there is no DIR in this case.

can i file a case against the judge, who has taken up the case with an invalid affidavit?

Date is mandatory on affidavit otherwise affidavit is incomplete and has no legal value. You can argue to order for proper affidavit.

It is mandatory for the court not to grant any relief without DIR report. You can argue on both the points

If you tell now, they will just file new affidavit with date and court will tell them to do that now only. Keep silent now. Use this later. But your Advocate's approval.
