signature on statement before police

"The lone arrested Pakistani terrorist Ajmal Amir Kasab had refused to sign the statement, recorded by police personnel on November 27 on the pretext of pain in his hand, Dr Vikas Kumar Kesari of Nair hospital told the designated court. "  - indlaw news.

Whether police could ask the accused to sign on the statement? s. 162 of Cr.PC provides for 'statement to police not to be signed'

Hi

Hi,

No person is induced to sign on the statement made by the Police officer or any other person. It is against Sec 162 of Cr. P.C..

Thanks & Regards,

Arvind Singh

If the police take the signature of the person making the statement under Sec. 162 of Cr.P.c then it is an useless paper. One cannot be forced to sign on such statements. But the case is otherwise when a confessional statement was recorded in which event the police can aske the giver to sign and in this case also it cannot be on pressure.
