only if the case in consumer court dismissed, you can issue notice for malicious prosecution and for defamation and proceed further.  at this stage no chance

Vikas Nagwan (Legal Consultant)     13 May 2011

i case of abuse and threat alone.. the consumer court doesn't have jurisdiction to try the case.... there must be some other string attached to your situation...please give us more facts...

Arup (UNEMPLOYED)     15 May 2011

IT WILL BE BETTER TO WAIT FOR THE RESULT OF CONSUMER COURT.

PERHAPS IN THE MEAN TIME YOU WANT TO TAKE PREPARATION.

FOR THAT PLEASE READ SEC 499 & 500 OF IPC.

A SEPERATE CIVIL LAW IS ALSO THERE FOR TO CLAIM COMPENSATION.

Vigneswaran (Lawyer)     21 May 2011

The finiding of the consumer court in case of dismissal of the complaint. it would help you as an added advantage

suryagaurav (manager)     21 May 2011

case is for dispute over money, that is separate matter as it is towards financial concern.

I want to initiuate defamation case for the writings given in complaint to consumer court regarding my image and behaviopur.

consumer will not take cognizance of my point.

its duty is to take issue of maoney matter only.

the complainant irrevantly written all those things without any evidence /proof.

so dismissal or not of complaint is separate matter.

I am confused.??????

A is within the exception, if he says this in good faith, inasmuch as the opinion which he expresses of Z respects Z's character only so far as it appears in Z's book, and no further.

Illustration A Judge censuring in good faith the conduct of a witness, or of an officer of the Court; a head of a department censuring in good faith those who are under his orders; a parent censuring in good faith a child in the presence of other children; a schoolmaster, whose authority is derived from a parent, censuring in good faith a pupil in the presence of other pupils; a master censuring a servant in good faith for remissness in service; a banker censuring in good faith the cashier of his bank for the conduct of such cashier as such cashier- are within this exception. " I want to initiuate defamation case for the writings given in complaint to consumer court regarding my image and behaviopur.

the complainant irrevantly written all those things without any evidence /proof."

---    a criminal court may take the cognigence of the above acts. not the consumer court. let consumer court works in it's own way.

file a seperate criminal case. it will be appropriate.

suryagaurav (manager)     02 June 2011

i just wanna be sure that whether anything written, on compalint in consumer court , can be eligible enough to file case at criminal court.

and how could I refer it to criminal court/civil court.

thanx
