i think in case of women only oral mentioning of suicide attempta is enough. our blind, idiotic, dumbo judicial system and common public will easily accept such claim.

To enforce the liability for cheque bounce it has to be proved that the cheque was issued in discharge of a legal liability. Therefore, you would have to prove that the accused was under a legal liability and he issued the cheque to dischare the said legal liability. Merely showing the bounced cheque shall not suffice. You would have to prove that the cheque was preceded by a legally enforceable debt.



The grounds on which the HC stayed the trial have to be looked into before giving a definitive opinion.

If you file for divorce on the ground of cruelty and, thereafter, she files a case against you under 498-A, her case would be seen by the judge as a counter blast to your case and would not stand against you in the court.

On behalf of my mother



My grandpa had 2 houses. He passed away 5 years back. My grandma is alive but however my uncle (mom's brother) has sold one of the houses without our consent although I think my mother has a stake on that property. We did not want to dirty ourselves in this but when my uncle stopped helping his mother and did not give her any share from the house that was sold she complained to us as we live in a different city without any contact. Now we want her to have the rightful share of the property and not conned by her own son. My mother wants to stake claim on the property to teach my uncle a lesson. 80% of the payment of the house that has been sold is done. Can we still get a stay order on it? Also is my mother in a position to stake her claim on the other house which is still in my grandpa's name. Once in our name we want to give it to my grandma so that she can lead a peaceful life till her death.



My uncle has sold the property to the buyer as if my grandma is selling it although he has been harrassing her and taking all the money back. Being in Mumbai my uncle gives her 500 rupees every month to survive. He has spent the 1 lac my grandpa had left for her. He has sold all her jewellery and has left her with nothing. I feel sorry about my grandma and want to get her some justice which she is looking for now.



The property is still in my grandpa's name and not in anyone else's name. How and what should we do? What are our chances of winning this one. Can someone take this case up in this forum?

Do you have any sample or draft copy of a similar contract as in above, as per below scenario



Contract between Indian entrepreneur and Foreign company.



Business area: IT services.



 



The above link talks about the Indian Company which is incorporated under the Laws of______. So for entrepreneur, what should I mention as per the rules so that the contract stands valid?



Also are there any rules which I should keep in mind while going forward?

We plan to buy a commercial flat (in a leasehold commercial complex) in Delhi. We are told that a transfer fees needs to be paid to the builder and the builder agreement will be endorsed in our favor. The building is about 20 years old and the flat has changed at least 3-4 hands in the same way.



 



Is it a legal way to transfer the property? Keeping in mind the notification issued by the Supreme Court of India on 14 October 2011 (that SA / GPA / Will transactions not valid), what will be the status of such a transfer?

Can you please suggest what should be next step for me?



I have filed RCR against my wife, In first sitting of counselling she had come with all false hand.



And she was asking magistrate for money to take care her and children.



And judge was saying her "we will see in the next sitting what she can do."



I am presuming she may back fire on me with section 125 maintanance case.



If she files maintance case,  does it indicate is she NOT going attening matrimony home?



What is the next step should I do?



By the way can I  show audio conversation clip to magistrate  at the time counselling to show my



cleanliness?



Please advice.

We wish to purchase a builder built commercial property (a flat in a commercial complex) in the name of HUF in Delhi. One of my friends informed me that if I buy property in HUF, the resale value will decrease by 10-20% because no buyers are interested in buying a property held in the name of HUF because of the formalities relating to obtaining NOC from members / co-parceners and no clear indication or list of members / co-parceners of the HUF. Please suggest if this is true. Should one not buy property in the name of HUF?

@ Mirage..I am apologetic to say that India is not U.S and there is no case in which Husband has ever get the maintanace or shre from the wife property.There was case in U.P in which unemployed Husband was awrded Rs 2000/- p.m by UP court which was set aside by the Appellate Court



As far as Dowry is concerned, there is law on giving dowry which was once charged aginst the father on the Bride but was set aside by the Applate Court..In India, Laws favors towards the women.Probably the law was made for protecting the weker sections of the society but whether they have aviled it or not? But surely middle class women had abused it so much that the Govt through Law Commission has been making it for reconisderation

Dear Sir/Madam



 



When I joined my company in 2004 the rule was that at the time of resignation I would have to give one months notice or one months salary. In 2008 my company made me sign a letter stating that i would have to give two months notice or two months salary(I was forced to sign the letter or else I would have resign).



In Jan 2012 due to personal problems I resigned by giving 2 days notice.



Now my company is asking me to pay two months Gross Salary,due to financial problems I am able to pay two months Basic Salary and not Gross Salary.



Since the company is not willing to accept Basic Salary from me and I cannot afford to pay them the Gross Salary can the company take any Legal action against me.

Madam Roshni, it is sad to hear your story. (Ofcourse you are right that such "crooked" women trap married men for money. And I also support you that such men needs to be shown the right path in a hard way.)



1) But will you please consider when things go the other way round, i.e. when the wife involves in adultery ???  In that case also if that hapless husband decides to divorce his unfaithful wife , he will have to give away a part of his hard earned income.   You support that ????



2) Will you support, Madam, such wife and her family who pressurize the husband not to keep relationship with his parents (who already resides thousands of KM away due to job of the husband) ??? And they are doing this to avail the company medical benefits for the wife's mother in place of the husband's mother (who is the actual beneficiary here by company rule ------- of course no mother-in-law is given medecal benefit by any company !!)



3) Will you support, Madam, when the wife and her family uses the threat that if the husband's parents comes to the husband's house they will be put to jail under IPC498 ??? Will you support, that the husband can't even call his parents (in case the wife comes to know about this she wud throw a tantrum over this) ???? Will you support, that the husband must disown his aged ailing father and cancer stricken mother ??? (That Mother who has done tuition to raise us --- she is also a woman !! ... those parents who have ate half-stomach but never let us feel the heat .) Fortunately I have an elder sister (and she is also a woman !!!!) who is a doctorate n taking good care of my parents .



And for your information, I didn't took a single paisa as dowry. (I Don't Sell Myself !!! .....  and yes, I have a big ego n proud of y own identity). I haven't taken a single paise even from my father after my high school , what to take from others !!!  (And yes, point 1 does not belong to my case).

hi..this is chimpy.I  am in trouble.I married my hubby against my parent's will.We have two daughter.He has affair with another girl since 3rd year of my marriage and want to sttle with her.He dont give me maintenance for kids, but want divorce and the elder daughter.



I am not willing to leave her with some other lady.I have helped him to become establish in life but he refuses now and all his family members support him in the next affair.I am desperate and in financial crisis as my younger daughter is too young to be left with maid.What should I do to get him back and teach a lesson to that girl who know me and my hubby prior to their affair..yet hooked with him.
