Gratuity

Hi all,

I have worked with a software company for an about 4yrs 7 months 9 days.

Though the company follows 5day working , had to work on Saturdays & Sundays .

I had even supported them on festivals.

pls let me know if i am eligible for gratuity.

my salary pay slip shows certain amount deducted as part of gratuity. when asked they say its a benefit from employer and part of our ctc.

need an expert advice and help here.

Dear queriest, it is a repeated query.  I opine your are not eligible for gratuity.

Tough the legal provisions mandate five years' completed service to be eligible for gratutity, some High Courts (Kerala, Madras etc.) have held that 240 days of service during the final yesr would suffice. 

There is no question of making any deduction towards gratuity; the practice has no sanction of law or practice.
