Registration for sale agreement

Sir

One of my friend is having tenement of MHADA.  The said tenement was purchased by his father Mr. Khare from Mrs.Usha. and only Sale Agreement on Rs.20/-stamp paper was executed and never registered. However his father is no more and he being only legal heir has to get the said property transferred in his name.  Now the MHADA Authorities want the document register with sub-registrar of properties alongwith stamp duty paid to enable  the son of Mr.Khare to transfer in his name.  Mrs. Usha is now willing to sign the document.  But since this document was already signed in the year 2001 in name of Mr.Khare who is now no more, how his son Mr.Vashu will get the document register in his name.  whether confirmation deed can be done and register with old sale agreement by paying present stamp duty as per ready recokner or whether fresh transfer deed has to be executed. please inform.  thanks

As Mrs. Usha is ready to execute a document, it can be executed in the name of your friend i.e. the legal heir of Mr. Khare on proper stamp duty on Market value as on the date.  it is for suggestion only.
