Need help regarding credit card

Hello Dear Lawyers,

 

I am Arun and I am facing an issue related to my credit card with HDFC bank. On several occasions I have been asking customer care to help me settle my ever growying balance however they only used to say that you need to pay the minimum amount due then next month the card will go for settlement which never happened. I stopped paying the bank since last three months and now collection people are harassing me and are trying to act rigid that you'll have to pay and we'll take it from you. Please let me know what action can I take to avoid this and settle my card account.

I have drawn a clear draft of what adding up all my previous dues plus all purchases made less all the payments done by me so far in last one year and requesting waiver for unusual interest charges and surprisingly that is much less that what bank calculates. I feel they cheat us on the statements too.

I have sent two notices to customer care for which no acknowledgement was received on asking as well, also I have sent the notice and a draft of my proposal for settlement to the nodal officer.

 

Please help me get out of this situation...

You have posted that:

Did you obtain complain/transaction/reference number or did the CCE issue it on its own and did you record the call?

Do you have the call history/bills e.g; date, time, your phone number from which call was made, phone number at which call was made?

Make another call and speak all dates, phone numbers, time, name of CCE and brief minutes of discussion (record this call) and ask the CCE to place the call to Manager and demand to listen to the calls and state what you reported is true or not and demand call recordings and offer to provide the CD and postage prepaid self addressed envelope to supply you the CD. YOU may also demand to read the notes entered by CCE word by word pertaining to calls made by you.

It is almost certain that call recordings shall not be supplied to you and CCE must have noted something else in computer note book as per drop down box provided to him/her.

Do not forget to record this call.

It is a veiled or even direct threat. Did you record these calls?

The recovery agencies and bank have to follow the guidelines issued by RBI and can’t be rude, intimidating.

Bank has to maintain the list of its recovery agencies on its website and has to supply you the letter/notice providing the details of recovery agency to which your case has been referred b y bank.

If you wish you can order them not to call you on phone and transact only by letter thru redg. Post.

Once ordered they can’t call you on your phone which is your property.

If it is so you may issue the notice to MD of the bank Aditya Puri with a copy to RBI, BO.

You may obtain the address of BO of your area from RBI website.

You may add that bank shall not send your details to CIBIL, Experian, Equiafax, Master Card negative feedback list, etc…………………………………………

You may also issue notice to CIBIL to not to include your name in list of defaulters.

If you are willing you can approach your lawyer to obtain injunction from court.

 If it is sent by email then bank has to supply the auto generated reference number by return of email.

It shall be appropriate to approach a lawyer handling such cases and proceed under expert advice of your lawyer.
