Power of attorney

I have a piece of vacant land. I would like know whether I can give a power of attorney to someone for 50% of UDS of this land. Does it really convey any power ? What the power agent can do with this? Request the members' views please.

Why would you want to do something like this in the first place? Even "assuming" that such a power can be given, it would create complications for the entire piece of land. If by chance the power holder creates some third party interest or if he sells the land to some party who is willing to buy the undivided land (normally at throwaway prices). Then the subsequent purchaser can institute a partition suit against you for partitioning the land into metes and bounds. Pure legal tangles.

 

Rather it is easier to subdivide the property and allocate such sub-divison alone under a power of attorney which would give you clarity and peace of mind.
