Land sold without my mother knowlege

Dear Sir/Madam,

 

I'm Mani from Chennai. We have house in dry land at my native which is owned by my father & mother name. 

 

4 years ago my father left to his mother house after he had fight with my mother and me.  Recently, we come to know that half of the land(include home) was sold to third party in the year of 2010,December without my mother knowledge and without signature of my mother. Whether the deal is done by my father is valid one?


Please advise me for this regard. thanks in advance.

Dear Querist,

 

Since he is a joint owner - he is within his rights to sell his part of the property. However that is not all, if the property in question is a dwelling house - the purchaser of half is not entitled to joint possession with you, and if he tries to sue for partition by filing a suit - you would have the option of buying out his share in what is called pre-emption.
