Defination of stridhan

Respected Experts,

This is a question from one of my friends who is a victim of Divorce.

He would like to know a defination of "Stridhan"

Stridhan is a jewellary etc. given to a Bride's by her parents, relatives & friends?

or

Stridhan includes jewellary etc. given by Bride's parents, relatives & friends and as well jewellary given by Groom's parents also?

Can wife claim Jewellary etc. given by Husband's parents also in case of MCD?

Can wife claim Jewellary etc. given by Husband's parents also in case of MCD?

yes

stridhan = any articles given to a lady at the time of marriage by anyone - it becomes her own property.

it includes anything right from petty handkerchief, nail paint, hair clips, sox to expensive jewellery.

What about the jewellery given by wife's parents to husband as gift during the marriage? Can wife claim that jewellery also in MCD?

Please explain. Thanks

in MCD all terms are decided mutually.

Otherwise things given to groom are not stridhan.

if it is not Stridhan.. then.. is it dowry?

Till the time wife says - this is my stridhan, it becomes stridhan.

when she says - these articles were given as dowry, it becomes dowry.

its a funny provision.

It is not so, her assertion can be anything, it has to be decided in trial according to settled principles.

@ Shonee Kapoor sir,

ya true.

but till the trial commences, wife's allegations are treated as prima facie evidences.

Dear Experts

How can a wife prove the items of stridhan ? what about gifts given after marriage ?she can just write anything in her list of stridhan as gifts given by groom ?? and claim them ???

Shonee Kapoor (Legal Evangelist - TRIPAKSHA)     21 March 2012

Prima facie is not proven.

Would the Engagement ring exchanged one day before marriage between groom and bride come under Stridhan?

If yes, then which ring can she claim, then one she was given from groom's side or the one given to groom by her father ?

Wat about the Mangalsutra worn by the groom on her neck ?
