406, 498a ipc against relatives of husban who are living abr

hi, i need your help. a fir has been registered against the relative of husban (mama & Mami) u/s 406, 498a ipc. the real facts are that they are living in Austria since last 22 years. marriage of their nephew performed 2003. after marriage they hardly visit india four times. they had never demanded dowry nor they have any kind of interferance in their life. can fir could be quashed agaunst them. and can somebody please refer some judgments of Apex court as well. thanks regards...
