Jurisdiction of practice by lawyers

Advocates can practice in courts across the country irrespective of their enrollment in any Bar Council without the need to transfer license to their desired States

 

Government has said that it has notified Section 30 of the Advocates Act, 1961 recently enabling the lawyers to practice in courts across the country irrespective of their enrolment in any Bar Council without the need to transfer license to their desired States.   

 

Giving this information in written reply to a question in the Lok Sabha, Shri Salman Khurshid, Minister of Law & Justice, said that subject to provision of the Advocates Act, 1961, every advocate whose name is entered in the State roll shall be entitled as of right to practice throughout the territories to which this Act extends. He informed the House that this section has come into force with effect from the 15th June, 2011

 

NOTE :   Advocates Act, 1961, is a Central Act and extends to whole of India.

Sir, I would like to ask u that I am a permanent employee and since 25 years I am working with Limited Company Now kindly advice me may I take sanath during my service.I have taken my LAW Degree from Gujarat University.pl suggest

but whether it is applicable to AOR or not 

If yes than Supreme court rules or advocate act, 1961 which one is a special act & central act. ALso what is the difference between central act & special act which one is more  binding.

This is not applicable to AOR. For becoming AOR they have to pass the exam.

Dear Mr.Rajendrakhatana,

 

You cannot obtain SANAT to practice as an Advocate , so long as  you are  in service of the Company.  If you want to practice in Court of Law, you should first quit you job and thereafter  approach your State Bar Council concerned for enrolment.
