Under order 39 rule 4 of c.p. code

I am a defendent in a partition suit. The schedule property is a house which is halfly constructed. After that the Court injuncted the defendent to construct the house. Now i am applying under Order 39 Rule 4. If anybody has a relevent citation in this regard then send it please..

Judgments are always applicable to facts,however O.39 rule 4 would be applicable if injunction is given exparte.

for violating the injunctiuon order you have to lead your evidence on IA with documentary evidence.
