PDPP Act 1984

Hi,

 Can anybody tell me whether sect 3 and 4 of prevention of Destruction of public property act 1984 is sessions triable or magistrate triable?its cognizable or non cognizable bailable offence?

Dear Querist,

 

In respect of your query, I am of the following view:

 

Section 3 of PDPP Act 1984 > Cognizable > Bailable > Trial by Magistrate of 1st Class (Punishment 6 months to 5 years)

 

Section 4 of PDPP Act 1984 > Cognizable > Non-Bailable > Sessions Trial. (Punishment 1 year to 11 years).

 

Trust this would suffice. However, please check STate ammendment in that regad.
