Anti employee move by MIB.

 

Some employees of Prasar Bharati, Broadacsting Corporation of India, are Central Govt. servants on deemed deputation since 1997. In 1999, their pay scales were upgraded by an agreement between the Govt. and the Employees Associations, on approval from the Cabinet and later by an executive order from Ministry of I & B. Ministry has also certified in 2006 that, “ the upgradation of pay scales was in continuation made by the Vth. Pay commission. These recommendations were made only after consultation with DOPT and Min. of Finance. As such the contentions of the audit that pay scales given to the employees, are apart from the recommendations of Vth. Pay commission is untenable.”

Govt. on losing couple of court cases in CAT and High Courts, judgments of  which have been upheld by the Apex court, now contemplating to withdraw the agreement and reduce the pay scales of the employees, 12 yrs after it was implemented and when two contempt of court cases are pending against the Govt..

Is the Govt. move legally tenable?
