Tenancy Agreement

Sir/Madam,

 

My father has a tenanted room in mumbai. Due to his bad health he wishes to transfer the tenancy rights to me under his own wishes. Pls let me know apart from the tenancy agreement what are the documents which would be required and under what act.

Hello..

In my opinion,No tenant can trasfer his tenancy right except the Rent Agreement provided it  and/or your land lord permit you to do so. I think  you need nothing other documents except you stated in your question for the transfer. from:- Shaulabh Shah Advocate. Website:- www.shaulabhshah.com

DEAR NITIN YOUR FATHER HAS NO LEGAL RIGHT TO TRANSFER THE TENANCY IN YOUR FAVOUR. IN YOUR  CASE TENANCY CAN BE TRANSFERED IN YOUR FAVOUR EITHER BY THE LANDLORD ENTERING INTO A FRESH AGREEMENT WITH YOU  AS OPINED BY ADVOCATE SHAULABH,SUBJECT TO SURRENDERING THE TENANCY BY YOUR FATHER.OR BY INHERITANCE AFTER DEMISE OF ORIGINAL TENANT PROVIDED THE OTHER RELATIVE SHOW AND PROVE THAT THEY WERE RESIDING WITH THE ORIGINAL TENANT AT THE TIME OF HIS DEATH.
