Writing a will

Hi sir. My mother bought 20 acres land 20 years back. Sale deed is on her name , but pattadar passbook on my brother. She can write a unregistered will on my brother with the help of sale deed. Please suggest me.

Your mother can write will in the name of your brother.

Thank you sir. I met sub register.H e told., In order to register a will, need to change pattadar passbook on my mother name. That's why I asked we can go for unregistered will or not . Thank you sir.

Dear querist, Will either registered or not last will come into force after  the death of the Testator.  If you mention the S.No. in the Will Deed, then it shall be tallied with webland of revenue authorites.  You shall consult RDO/SDO concerned to mutate your mother's name in Webland.  Then it will be reflected in Subregistrar's web site and he will register the will.  Or in the Will deed you do not mention the S.No..  You can get the draft as "after my death all of my properties shall devolve to ......................" then Sub registrar cannot ask pattadar pass book.

Sir. The same self acquired land we put i n court by mistake and lawyer submitted vakaltnama to remove from court papers. So now my mother can write a will for that land. Please suggest me.

Lawyer told it wil take time to remove the said property from court papers.

Whether we can write a will on stamp paper or not. Eventhough I don't want to register a will.
