Query regarding the value of xerox certificate in any case

What is the value of a xerox certificate in any case under section 420/468IPC?

Dear Hanif, 

Under Section 65 in Indian Evidence Act 1872, xerox copies are considered as Secondary Evidence in few conditions such as

  • When it is to be shown against the person,
  • when the originals are with accused or conclusively, in a absence of primary evidences or the originals documents.

Dear Anaita, 

It has been explained in Sec 65, of the Indian Evidence Act, 1872 that to produce the Secondary evidence, party must prove that they are not able to produce the originals in few circumstances. And the submission of secondary evidence is allowed only in certain specific conditions like

  • Where originals has been lost or destroyed. 
  • Where originals are in custody of third party. 

Although, Secondary evidence is a certified copies, it must be registered as certifying like true copy.
