maintenance

last year wife has filled false case of 498a on me and also asked me for interim maintenance under crpc 125 where she told I earns 40000 per month but my per month income fluctuates in between 8-10k nd I stay in rental house where rent is RS.3500 nd my lawyer has already taken 2adjournments although my objection is ready..wife is qualified gives tutions same as me n earns near about 8-10k also.What can be done by me to avoid maintenance as i m financially not capable..parents has also filled senior citizen case on me where it has been ordered from court to pay RS.2500-3000 per month..hardly 2500 remains with me.

Dear querist,

 

Maintenance will be awarded as per your income proof given by your wife, without proof court will not consider as income.

sir she has although no proof and even if she shows proof it can't be of more than 8k which I was earning per month but isn't lower court should look after the liabilities which I have to pay every month in that earning i.e- 3500 for my house rent,I don't have my ownership house ND there is an another case in which I was ordered to payRS.2500 to my old aged parents(senior citizens)..nd now money which remains with me is 2000 RS in which electricity bill is also included..hardly 1500 is the amount which remains with me
