Deemed decree of pre-emption in a partition suit

My short question is whether a deemed decree of pre-emption passed in a Partion Suit upon allowing the defendant's application under Section 4 of Partition Act be said to be a decree in accordance with provisions of Order XX Rule 14 of Civil Procedure Code? If so, authorities on the same may be kindly provided.

A response at the earliest possible shall be highly appreciated.
