I had booked a flat with Godrej in Ahmedabad. Agreement to Sale (ATS) was registered in registrar office between me and Godrej. While registering the ATS, we have not paid any stamp duty or registration in registrar office. It was just Registered. (I think in Gujarati it is called Banakhat). However I have paid 10% booking amount to Godrej
Due to some misleading information regarding the project given by Godrej, now I want to cancel the booking of flat. Godrej has asked me to de-register the ATS at registrar office. Godrej has also informed me that while de-registration, I have to pay 1% of total sale consideration (Approxiamately 32000 Rs) to registrar as cancellation fee of registered ATS
I have two doubts
1. Is it true that 1% of sale consideration has to be paid to registrar office?
2. I have not paid any stamp duty & registration while registering ATS. So why should I pay 1% now just to de-register the ATS?
