Notice of motion

I was acquitted in district court from a case under section 138 N.I act . The judgement was � dismissed in default � Uncontested . The complainant and his counsel didn�t attended 5 dates . Now the complainant has filed a petition in high court in which it says that the learned counsel for the applicant contends that even for a single default the accused got acquitted by the aforesaid judgment . Now the high court judge has served me a notice of motion . What steps should I take for permanent relief?
