i filed a partition suit against my brother in a district court.. this was for our ancestral property. passed to my father who is the only child and no mutation done till date..and then it is myslf and my brother only as legal hiers of my brother.we are hindu family based out of Kurnool district.the property is under possessin and enjoyment of my brother for last 20 years... filed case and after 2 yrs, my brother never replied to the summons and all atempts, and finally it was set a ex parte for him.and i am waiting for a decree and judgement soon.
with this state, can i take possession of the property? will ths exparte have the same effect as any other decree. can i use police help to take my share and move int the hosue or sell my share.
