Kindly advice.
Lands that have been transferred before 1-1-1949 and have completed 30 years prior to the 1979 Act are exempted from the PTCL act. Additionally, if an SC/ ST Land was sold after alienation period but before 1979, then such sales can be considered allowed as the PTCL act came into existence in 1979.
In my case,Granted in 1955-56 with condition not to alienate for 15years Sold in 1977 (after 22years) So clearly our case will not attract the PTCL Act. AC office also ruled accordingly. now the case is before DC. Will there be any possibility to invoke any provision of law by one of the seller just to create instability in the project.
