Need help in intrim maintance case

Hi,


My brother inlaw filed divorce case against my sister which is running. Inturn we filed a Intrim maintanance case. At the time of filing she was not working. After 3 months of filing she got a job and started working. Now the other party came to know that she is working. She has resigned the job and in notice period stating medical issues. Does she have a chance of any maintanance.

Do not worry at ,present your sister is unemployed so she can claim maintenance

As per various judgements, a wife who has a good educational qualification, has worked before and can earn for herself, will not be granted maintenance.

Yes, she has good chance for maintenance. Present income of wife is looked into and for husband, his capacity to earn and ``able body ``principle is looked into.

even if she has income but which is not sufficient to maitain herself, she can approach the court for remaining amount of maintainance .
