I have a friend who has filed partition suit against his brothers. The suit is decreed in his favour and defendants have filed appeal before Dis Court. There are 10 properties. Now my friend wants to sell one of the suit schedule properties standing in his name so as to purchase another valuable property of the same area which is more beneficial to all the parties. Even defendants are consenting for this. Both Appellants and Respondents are ready to this transaction as the property to be sold is less valuable than than the property to be purchased. Please let me know the procedure and kindly upload model application form and affidavit. Kindly give your opinion.
