Eligible for punitive damage?

I have filed a complaint against MSEB in the district consumer court. The complaint was filed in Augast 2013. Many hearings went on (kindly refer to my earlier post on this) . Some hearings got adjourned however the problem is opposite party has till now not filed its reply. I have filed for ex-parte order. My question is can I claim punitive damage from MSEB for not filing reply in time?
