Sir,

Already paying I/A of 3k per month for the past 3 years.

Wife filed DV case against me and my parents a year ago which was eventually set aside by sessions court.

Now that wife already recieving maintenance under family court (divorce petition pending) can she still claim additional maintenance (money) stating that she doest not have shelter ?

She though claims of having no shelter, it has been proved that she has put a false address only to file DV act case.

Please advice.

As your mtn order is 3 yrs old , 

with change of circumstances or inflation/ price rise and cost of living std going up, , she have legal right to do so. 

she can ask residence too, if she have no place to reside. 

Laws protects woman, not man . 

You are right sir, as time passes, they can ask for more money. But they cant ask money under two diffrent laws.

When they already asking money and getting money according to Family Court order.

Now she cant claim some more money stating the same facts elsewhere in another court, I am in a state of confusoin. 

Please help.

no judge is giong ton grant money illegally. 

He will act if law permits him

eARLIER mAINTENANCE GRANTED IS CONSIDERED IN  PRESENT  aPLICATION. yOU HAVE TO PRODUCE CERTIFIED TRUE COPY OF THOSE JUDGEMENT, AND TAKE ON RECORD. .

It keeps on happening all the time.
