Raj Singh Sharma (manager)     19 October 2013

Hello Mr. Vellore

thank you for your reply. As far as any agreement is concern so we have only one cash receipt paper .. on which we have mentioned that if buyer back off from the deal the money will not be paid off and if seller back off than he will pay 2 times of the paid amount to the buyer .. but it was all on the cash receipt on which revenue stamp is pasted

T. Kalaiselvan, Advocate (Advocate)     19 October 2013

Mr.Sharma,

Dont worry, you have not entered into an agreement at all or if at all there is one it is only oral which is unenforceable because it is lacking the clear contents of the agreement, thus on the basis of the receipt of having received the cash, you may issue a legal notice to him to return your money stating that he violated the agreement conditions hence since you are not interested any more in the purchase, you are asking for return of money given by you in this regard and the proof is the receipt in your possession duly signed by him.  If he refuses to return the money, proceed with a money recovery suit against him.

This refers to your PM as well.

You can not get the specific performance of the contract as the agreement is not registered which is mandatory. Any unregistered agreement shall not be admitted in evidence. However you can claim damages for breach of contract by filing recovery suit. .
