The Hindu Succession(A) Act 2005

Page no : 2

deepak (business)     15 November 2013

respected sir:

As per mr pranjal srivastava stating that:

Yes Date of birth of any female makes no differences  Provided that nothing contained in this sub-section shall affect or invalidate any disposition or alienation including any partition or testamentary disposition of property which had taken place before the 20th day of December, 2004.

Above said means if the partition of the property had been taken place before 20 dec 2004 only then she can not claim.

What happens if there is a partition between brothers after the death of father

1)one of the women is not a signatory body to the said partition deed

2)and, the partition deed is not registered.

3)all brothers accepted the partition deed except the one women saying it is not binding on her as she is not a signatory body for the deed.

4) Partition deed executed on the year 1975. after the death of father . Among brothers  and mother excluding one sister who is born before 1956

5) can she still challenge in the court for her share in the properties whic has been shared.

please suggest me....

yours sincere

deepak
