ipc 107 and 151

person was arrested and ioc 107 and 151 were imposed for normal fight between brothers

released on next day after on jamanat from tehsildar.

now clerk maintaning file gave date to report him every month.. is this procedure is legal after release or clerk foooling person

Dear Sudhi!

Please refer the Sec. 151 which reds as

"Knowingly joining or continuing in assembly of five or more persons after it has been commanded to disperse.—Whoever knowingly joins or continues in any assembly of five or more persons likely to cause a disturbance of the public peace, after such assembly has been lawfully commanded to disperse, shall be punished with imprisonment of either descripttion for a term which may extend to six months, or with fine, or with both".

Hence, the perosns involved in the fight could be booked guilty, if proven.

kindly make morw clear.. i want to know persons aalready released on bond and clerk giving verbal date to be present before him.

advocate says no need to visit this tehsil clerk but clerk giving verbal date to be present..

so is there need as clerk thretens foe arrest warrant..

this was a dispute between brothers at home
