Sec 13 and sec 9 together

My wife filed 125 against me. She got 10k per month. Now I filed 13 for divorce. To quash that case she filed sec 9 . What should be my next action. Because both the cases are different and order will be totally different in both the cases

Ask your lawyer.

The cases may be different, but both can be clubed together by the Family Court and decided together, either both cases get dismissed, or one of it get decreed and otherone dismissed.

Thanks a lot for your reply sir

which court will prefer by family court to clubbed. as both the cases were proceeding in diffrent states i.e MP and Maharashtra.

And which case will be consider on 1st priority if its on a dissmissed conditions

Get both cases clubbed in one court to avoid duplicacy. Your lawyers in both cases should workout this issue amicably.

Your cases would get clubbed only by way of a Transfer Petition which is to be filed in Supreme Court, as it is to be transfered interstate (from MP to Maharashtra or MP to Maharashtra).
