Consumer protection act

Hi,

A company has taken an Fidelity Insurance policy from insurance comapny against the frauds done by the employee. The insurance company rejected the claim. Can company file the case against the insurace comapny under Consumer protection Act. Whether company can be treated as consumer in this case.
