Execution matter for Arrear amount u/s CPC O.21 is going on for Interim Order passed under Hindu Adoptions & Maint. Act.
All arrears will be cleared in next date. But Judge is saying clear all due till date not what was pleaded in execution main application
The execution sub-matter was filed for specific amount of arrears till specific date in 2015. Monthly maintentance amounts is beiing paid into the main matter
In main matter, since 6 dates, Judge not passing order on application to Cancel Interim based on her Job admission in cross
Execution matter running in different court to main matter
(a) How to convince Judge to dispose execution matter with only specific arrear amount as specified in main application ?
Any citations, sections of law will be useful.
(b) Suppose I pay all amount till date in execution sub-matter. And Interim Order is reduced/ cancelled in main matter. Is recovery of several lakhs possible from wife back to husband , Can I press in same execution matter recovery from Wife ?
