Problem in association

Hello,

I am belong to rajkot gujarat, and having a shop in a building having total 76 shops only. the problem is builder is first make two floors (i.e. ground floor and first floor) and make AOP for association (not having registrar number, also dont know is it needed as builder say thay do AOP in stamp paper) and handover money to association for ground-first floor, after 12 years he build another 2 floors (2nd and 3rd floor yet builder has aprroval of 4th floor) and collecting money from us for association, mean while the precident of ground and first floor run away and make their account balance zero, and people of ground and first floor made police complain for same.

Now the question is arize that builder want precident, secretery and treasurer names from 2nd and 3rd floor and advised to make saperate association(also there is huge amount difference builder taken from ground-first floor and second-third floor), is this possible, also AOP is leagal to firm association of this such kind?

can this type of building aprroved for two association?

What are our rights? because as of now our money is with builder and we have trouble to manage our two floors.

it is better to say to builder to make a co-operative society

if builder is not ready and take 10 suppoters with u and go to a local lawyer who will register a co-operative society for you

once co-operative society is registered then file case on builder for recover of money

Thanks for giving prompt reply.

Builder is not ready for make any society, another he said that he ready to make extantion in AOP(Association of Persons) so as second, third and forth floor can join that association of persons(AOP), and tell us that we cannot make another association as the building is already joint with his AOP, but we do not want to join that accociation as it has already police case, and there is no fund in that right now.

another thing is that people of ground and first floor not known that builder has make this kind of AOP nobody sign for that so is that aop legal?

what can we do in this situation?
