Can photocopies of property documents be misused?

Dear Sir,

I had given a set of (all photocopies) property documents including sale deed to a bank loan agent for the purpose of loan transfer from another bank. For some reason, I did not proceed with loan transfer process but fear about the chances of document misuse by the agent. Please advise.

Thank you

When ever photo copies are any documents are given, it is proper to mention the purpose of giving it, to whom it was submitted and when it was submitted on each page with full signature so that it can not be misused.  These details to be incorporated at a place where deleting or applying white liquid/erasing fluid can not be applied.

The owner may not be knowing as to Who misused, when it was misused , unless he writes the particulars.

One can not doubt all the time, and because it was given to a professional, at this point of time, there may not be any danger.  But to avoid such risks, atleat in future, or now it is better to incorporate the facts.

Many citizens have even prepared a rubber stamp in the following manner and using it when providing any copy including AADHAR and Voter card.

This Xerox copy given for the purpose of...................to .......................on............................

Suggestion by Mr.G.L.N.Prasad is good.

Agreed with Mr.G.L.N.Prasad, Mr. Kishore Mehta.

Call the said agent and ask him to return the copies, and loan application etc, if he has not submitted. .

If he/she has submitted the papers to bank then ask the agent and bank to supply you the authenticated copies of forms signed by you and ( with seal and signature of the bank/banker with date) and enclosures.

Be clear while writing to the bank ( under proper acknowledgment0) that you do not want to avail the loan and are withdrawing and bank should confirm on it.

The Bank never calls for any documents till it sanctions the amount.  Before loan is sanctioned the NIL encumberance certificate, Link documentstax paid receipts etc are required.  The agent has some connections to obtain (on line) and himself checks the documents or collects certified copies, to help the customer.  It is always the Agent who undertakes the job of borrower, as borrower may be busy or he reimburses costs and do not want that troubles.
