Hi Everybody,
Orginal Plaintiff filed partition suit in respect of the propoerties stading in the name of his father. later he reliazed that certain propoerties are illegal mutated in the name of his father and admmitted in the cross examanation. During evidence orginal plaintiff died.
later his children brought record and based on admttion given by his father filed application for deletion of govt propoerties by filing application under order 6 rule 16 of CPC saying that those are Govt propoerties resumed to govt.
Please provide land mark judgments of HIGHCOURT/SUPREME COURT about the duty of the civil court to protect government propoerties.RMD Advocate
