loan recovery

one person has bought 50000 rs from me by giving me signed cheque and voucher and document. now he is not giving back money. saying "i don't have money.you go to court . i"l file yellow notice (bankruptcy)". what shall i do? he doesn't have any asset. No use when i tried to talk with intermediate. is there any way i can send him to jail. because if there is possibility of him going to jail, then i am sure he will pay back the money.
