My father in law is a govt. employee. He is 55yrs old. He has 3 daughters, twice already married. But he has done 2nd marriage without asking his first wife. Now what to do my mother in law...?

Actually my father in law is a muslim govt. employee working as Radiographer in Health dept. of Assam.He has 3 daughters, twice already married. But he has done second marry without permission his first wife. Now my mother in law, means first wife want to take action against her husband. So plz advice what is the best Section under law is acceptable. Thnk u.

One cannot expect a person stranger to govt service to:-

 

  1. Which part of the enormous set of service rule prohibits bigamy by govt servant?
  2. on which site it is available (certainly not the site of the deptt where one is serving).
  3. how to locate specific provision in that rule.
  4. the understand course of action.

Ask your mother-in-law to just give a complaint on plain papr to head of the deptt whre your father in law is serving with details ofsecfond wife and proof of marraige.

A govt servant is liable for disciplinary action which can result in dismissal from service if one commits second marriage (even without complaint from first wife) even if the second marriage is permitted in Islam.

Further. bigamy is violation of one of the provisions of CCS(Conduct) Rules [or other identical rule of state govt or a PSU] , like many other misconducts but bigamy is also :-

 

  1. Violation of the condition of eligibility in the recruitment rules for the post he holds.
  2.  Violation of the conditions stated in offer of appointment.
  3. Violation of the undertaking he gave while joining service when he reported first day for duty.
