Need help on passport application - i have dv act sec 12

Hello Sir,

I am applying for passport renewal and there is a colum in passport applicaion where it asks "provide the following details if there are any criminal proceedings pending against the applicant".

My wife has filed a case on me under DV act under section 12(1) and case is under way of magistrate court and final orders is pending.

Should I select "Yes" in my passport renewal application as i have a case on me or should i select "NO" as this case is not a criminal case.

Please help me.
