Leave application while on pending vigilance case

A vigilance case is pending against an employee. She asked for childcare leave. Employer( a PSU) refused with the plea of vigilance case. How to get the said leave in this case.

Have they communicated as such in writing, as any rejection of leave must be stated in writing by employer with such valid reasons ?

Have you specifically stated the reason for such leave as "Child Care" in your application ?

If so, contact the Union or Legal Services Authority, and also make a separate representation to the Higher Authority as grievance in their on line portal pgportal as human rights angle is also involved.  When even convicts can take such Parole, why not alleged ?  Have you stated in application that you can come as and when you are called for investigation on your own costs on such dates as decided by competent authority ?

Submit leave application as suggested and let the authotity decline in writing.

ask the dept to quote under what rule they decline your childcare leave if some happens to the child will the psu pay you liquidated damages of exemplary nature, sutomatically they will allow leave,

Pending vigilance case is not a ground for denial of any kinf of leave. However, please note that sanction of leave is the at the discretion of the leave sanctioning authority.

Agreeing with Mr. P. Venu.

Some leave is usually not declined.

Submit leave application with descripttion.

The authortity has discretion to sanction or decline (with reason).

Thank u all for your valuable suggestions.Department head  refused to forward the application and also the HR people refused to receive the application. What are the ways in that case?

Send it by Regd post, and specifically record such refusal.  A copy may also be sent to higher authorities.  To sanction or rejection with reasons is the law.  But rejection of leave application was unheard and amounts to failing in duty.

If a male, he cannot expect childcare leave. If female she should have fulfilled the prescribed conditions about the eligibility of childcare leave.

You have not given proper case history as well as the reason for rejection, if conveyed. Without discussion of the facts, you cannot expect solution to your problem.

 I have already given  the case history in my first post. She is a employee in a PSU with 10 yrs service . Applying for child care leave for the 1st child of 2 yrs age. Enquiry pending for a vigilance case in service matter.

Which first post you are referring? Your initial query, states, as "A vigilance case is pending against an employee. She asked for childcare leave. Employer( a PSU) refused with the plea of vigilance case. How to get the said leave in this case." That does not reveal any case history. If you expect the members to search your other questions somewhere else by themselves, your expectations are quite unjustified. Your query at any thread, itself should contain proper background of the case.
