flat owners - society laws

The builder of our society has marked half of common terrace to penthouse owner in his sale agreement. At time of conveyance he has taken all members sign for the same. Can i approach registrar and reverse the terrace allotment to the member ? Same goes for 1 side of the building compound which he has alloted to the same member to use for his car parkings. Can this be reversed too ?

When all the members have agreed and signed the same, there is no question of reversing it.

 The query needs clarify. Are you a Member from the origin! Have you signed the conveyance. Has the interest of the pent-house member recognized by the society (has society been formed). What is the basis of the maintenance charges for the penthouse-is the terrace area computed for maintenance charges. Does the building plan (approved) reflects all this allotments.

Brand new building. Conveyance not yet done - builder says he will take sign of all members on allotment of parkings and terrace before conveyance. BMC plan shows the terrace as common terrace. OC just received.

since all of u signed u have no right to reverse it. Better call for meeting and try for amicable settlement.
