High tension towers shifted close to our property - advice?

We own a property in Bangalore. We are currently facing a problem where High Voltage towers are being shifted very close to our property wall to felicitate the construction of high rises next to our property. Basically when we purchased our property (gated community) the HT towers were about 200 mts from our wall and going in a direction away from us. The land adjacent to us was also purchased by our builder with plans to develop villas there too. In fact one of the sales pitch was that since they own the land we do not have to worry about any high rises coming there. Now three years later they are developing that into a concrete jungle with 19 towers coming up right behind us and to felicitate the sales of the highrises they got the the HT towers shifted to our side. Now we have towers already installed 3 mts from our wall running parallel to our boundary.

As per them all safety norms have been met and 3.5 mts or so is the minimum required clearance. The problem for us is we cannot prove in anyway the builder had promised villas behind us and not high rises. And if we go to court to shift the tower to another side BESCOM would say the safety standards are met at this location too. Several of the residents are worried about the safety aspects since there are many studies showing some health hazard for living near HT lines. More than that is the devaluation the property is going to face with these ugly towers and wires running right behind us. None of us would have purchased this property if the HT lines were running right behind us.

Searching on net showed Pashmina Waterfront had HT lines running through the property and had a court order to change it. I was wondering if anyone can suggest a way to get out of our problem. Thanks

Gather through RTI about the safety measures adopted by the BESCOM do conform the permitted extent, and what are other precautionary measures to be adopted while erecting such towers near residential area.  If you find the information furnished is not reliable or not satisfying the safety measures as envisaged in the statutory rules meant for this, you may file a suit for mandatory injunction to remove the same from the vicinity, take the help of a local lawyer or gather all those affected by this drastic action of the authority, make a joint representation to the concerned authorities  seeking relief.  You may simultaneously arrange for a press release too on the safety of the residents.

Thanks for the reply. We are in the process of gathering information through RTI. But from what we have researched all the safety rules would be met. The safety rules state just a 4 meter horizontal distance is enough to be maintained from the towers. But imagine the devaluation that is going to happen to a property that is situated just 4m from a High Tension tower. 

Since this tower is being shifted closer to us by our builder, to felicitate the construction of apartments in the adjacent plot by the same builder does this form a breach of ethics? And if they are not ready to move this away from us, can we ask for compensation? Or what other option do we have?

Dear Deepa,

We dragged into the exact situation only difference in our case is not the same builder. Could you please guide or suggest on how you overcome the situation?
