can respondent or petitioner be penalized for unproven allegations of cheating , adultery etc.

How can one get punishment when the offence is not proved? No way.

Court decides whether the allegations are proved or not and punishes the offender if proved or may acquit him if allegations not proved. Then it is the decision of the person aquitted to file a suit for defamation for evrything he had to suffer from the person alleged. But it is not worth making trips to court for that after one has been aquitted. :)
