Father wants to throw her daughter out of home

Father wants to sell his home and throw his only daughter out of home as she is not ready to marry as per her fathers wish. Can a father do that? How to stop it? The daughter is only child, 26 years old, unmarried.

Dear Arup

if the property is ancestral then he can no do that but if the property is self acquired by her father then he has right to sell or do as per his wish, nobody can interfare with his rights.

How to make or convert the inherited property to self earned property? Any idea or law options for doing it?

Thank you Nadeemji. But then where will an unmarried daughter stay? Doesn't she has a right to stay in her house?  Doesnt her father BOUND to give her unmarried daughter a shelter?

As nadeem had already clarified,  If it is ancestral property you can claim your right.  If it is self acquired prperty, you cannot claim.  Coming to maintenance issue, if you are minor you can claim maintenance from your parents through your guardian.  Once you married, your husband will look after your welfare.

Seek relief under DOMESTIC VIOLENCE ACT.

There is much than meets the eye in the querry.  If she is employed, why does not she go to working women's hostel?  If she is not employed, she should convince her father that till she gets a job she is not interested in marriage.

Otherwise as suggested by some above experts, DV Act is there and S.125 Cr.P.C. is there, but employing them will further accentuate the bad blood between them.

going legally you will spoil your relations even worse then never

if you are not interested then talk to your father and do some job as per his wishes and also if you are not interested right now then it is better to talk to your father and seek some time to married of your choice or your father choice because the property is your father self acquired property and he has every right to sell it to any one and before that your should be stable to make yourself stand if your come out of your house so seek some time from your father for marriage and then take up a job

some stay unmarried for a lifetime, better to join brahma kumaris and let old age parents be at peace.

Law may help you.  But this looks like a nut case to me. Not mending ways, hence father is telling get out.  Or else which father on earth will tell to his own dotter, get out.

Children should not take parents love for granted and in turn parents for granted.  If they do,this is what happens.  Now you are consulting advocates, later on no wonder if you will be roaming court halls penniless.

Go listen to what your dad says would be my advice to you kid.
