Affidavit in family court

Hi,

 

Is it compulsory now in the family courts in Delhi to give financial affidavit giving details of all the assets, income and expenses by both the parties ?

If yes then for which period it is required ?

If the assets have been aquired before marriage then they are also required to be shown or not ?

Only assets aqcuired from the date of marriage ttill date are required to be given or all of them ?

Please advise.

1. Yes all questioned by you are put and it is asked by Ld. PO in all Courts handling family law matters to decide maintenance.
2. PM @ Zeeshan I gave the copy to him Or search his thread post which I replied annexing the paras of the Affidavit.

Total assets means ......do we have to disclose HUF assets also? (HUF started after 4 yrs of marriage, husband is KARTA)

Sir,

 

Do they see whether wife has any contribution in these things or not or just decide maintenance ?

 

If wife herself has deserted husband and he is still ready to keep and maintain her then what will the court do ?

 

What about assets acquired before marriage ?

I have my doubts about the correctness of the said judgment. However in Delhi it is compulsory. Someone can take it to SC for clarification.

Shonee Ji,

save India Foundation can take it to SC as it is giving rise to greed of wifes and their families once they come to know something extra in the affidavit and the black mailing is inrcreasing further.

 

Kindly take it to SC through Save India as such type of affidavits have never been asked from big scamsters also.

Sir,

 

I had seen that jusgement and it says that this judgement be sent/circulated  to family courts in Delhi but it has not mentioned that they must use it or is binding in all the cases.

 

What is the escape route.

No escape route. The only escape is to challange the correctness of it.
