As per Hindu Marraige Act, the second marraige is void marraige.
But if the marraige has happned, whether the second wife can use the Surname of her husband and whether it will be a valid name.

1. NO; if the spouse has objection then he can jolly well object to it and get her renounce his surname / family name.

as you said himself and also mentioned and fact of law that in hindu marriage cat second marriage is void when first marriage is still existing so there is no question of rights by the second wife but the children of second wife will get all rights and benefits also in property and share of that person as children from first marrige will get.

reading this post,
i have filed an application in my IPC 494 case -
the documents submitted by void wife be cancelled and not to be read in evidence. 
Member Strength 9,46,652 and growing..
