Unable to pay court fee

Dear Sir/Madam,

In a partition suit to be filed in BOMBAY HIGH COURT:

If the value of the properties runs into a few crores & the plaintiff is not able to pay the court fee what are the options (if any) available to the plaintiff.

How is the court fee, like what is the % of the market value of the assets?

Is there an option for the Plaintiff to request the court to deduct the court fee from the plaintiff's share of the property at the time of partition?

Another point is I don't know (no relative or friend willing to help) the real market value of the assests in Punjab how does one calculate the court fee in such a case ?

Please guide.

Dear B-Man, 

Supreme Court has ruled that in a suit for partition where the person is not in possession, court fees has to be paid on the value of share a person has in such property and not the entire property.

There are charts of ad valorem duty. Google it ! 

To calculate value - see the circle rates of the property in the revenue records.
