498a complaint

Hello All,

 

Can false complaint of 498A can be closed at complaint level itself , if we can convince Investigating officer at police station ? Or it has to be converted to FIR and then removing all charges from the charge sheet after investigation ..

 

In my case IO is convinced that complaint is false, i would like to know what would happen next ..

 

Please suggest.

It can be closed if FIR is not registered by the IO but the bigger question is that the IO may fool you as IO would be convinced basis the expectation he would have set with you for some money and would have promised you to do that but these policemen cant be trusted. The complainant would also be following up on the complaint and would be pressurising the IO to register a FIR. IO would take money from both sides and may later register the FIR.

Let me rephrase the question,

 

Can IO close the 498A complaint after initial investigation itself ? I mean does the law has this provision

Yes the IO can close before FIR there is a provision

YES. The IO is competent to close the complaint, if found manifestedly false.

How do we come to know about closure of the complaint ?

Can we file RTI for the same ?

Ask the IO itself.

 

They provide such information easily.

 

Then if you need certified copy ot it, file RTI.
