498a quash stayed

Hi,

We have applied for 498A quash, Case was not that strong.

FIR/ charge sheet statements are contradictory.

High court has given stay until further orders.

whats the strategy to be followed to fight the case.

Contest the case on merits.

 

Now it is a matter of arguments by your lawyer at HC.

Hi Shonne Ji,

I am your follower in FB and Other Areas. You are inspiration to me. Thank you for your Response.

As the opposite party is not taking the notices served since past 9 months, HC has given a permanant stay until further orders.

Well We have to wait until Party who has given complaint has to come to HC for any proceedings to happen. But they are not taking any notices.

We are planning to wait for sometime. I mean court will also wait until other party responds. Now we can't fight until unless other party responds.

What If they donot respond at all for HC Notices.

Please advice what strategy we have to follow.

Publication means the notice would be published in the newspaper, that is notice to public.

 

If even after that they don't appear, the HC would continue the matter, with the assumption that the other party doesnot want to respond to the notice

you can also approch HC regarding quashing the petition and strongly press the point of facts and law with showing behavior of the complainant/petitioner.
